Preemption is a nuanced legal doctrine, with many exceptions.
One, is that federal law only preempts what it specifically preempts, leaving the rest up to the states. However, federal law bans the commercial sale of marijuana, but several states allow that without federal repercussion so far. Similarly, many states require compliance with federal laws, however, there are several cities throughout the country that have declared their fair cities as "sanctuaries" for people who are in that city, that state, that country illegally.
