# Looks like Cash Converters don't have a sense of humour...

# I did actually.
Now I say that you should reply thusly:

THHRRRUUUUPP!!!!!!!

# What are you talking about? There's only one letter!

# I don't know
they did say "no pun intended"!

Edit/ they're also keen to point out they do have a sense of humour... which is a bit like saying, "I'm not racist but..."
(, Fri 30 Mar 2012, 10:13, archived)
# No pun intended? Bollocks, they were banking on that one!
(, Fri 30 Mar 2012, 10:14, archived)
#
So, am I in the shit or are they chancing their arm? I did check and there's no trademark against their logo.
(, Fri 30 Mar 2012, 10:14, archived)
# Quick! Get yours trademarked
Then fuck them for infringement.
(, Fri 30 Mar 2012, 10:18, archived)
# haha this ^

# < The other
But yes, do this. Do it now.
(, Fri 30 Mar 2012, 16:07, archived)
# Actually, this might be the right thing to do!
Their last registered logo was the one here: www.ipo.gov.uk/domestic?domesticnum=1537753
and it has expired. I can't find any record of registration of the logo. If they register it now, I suspect you could easily show that you had been using your logo before they started using registered theirs, and although you probably couldn't get away with claiming that they copied or infringed yours, it might severely clip their toenails.
(, Fri 30 Mar 2012, 11:42, archived)
# nicey done!
it seems that their current logo was never trade marked, so fuck 'em
(, Fri 30 Mar 2012, 12:40, archived)
# Do you get a lot of page views?
You could do a deal with them on a "Looking for cashconverters? click here" link.
(, Fri 30 Mar 2012, 10:20, archived)
# Well, I'm not a legal professional
so all I can really do is just strip naked and roll around the floor.

*strips naked*

*rolls about*

OH MAN! Best feeling ever!
(, Fri 30 Mar 2012, 10:21, archived)
# If only everyone who isn't a legal professional had this kind of sense
(, Fri 30 Mar 2012, 10:26, archived)
# Indeed, the world would be a happier more rolled upon place.
(, Fri 30 Mar 2012, 10:27, archived)
# Fortunately, whilst I am not a legal professional
whilst I am not a legal professionalall I can do is film people rolling around on the floor having first stripped naked

*filums*

(, Fri 30 Mar 2012, 10:26, archived)
# Interestingly enough I am
actually a legal professional (no, really) who specialises in this sort of thing (I usually write these sorts of letters (though my ones are much, much better)). Despite this all I can do is also film people rolling around on the floor.

# This shall also be my defence in court should the situation arise
(, Fri 30 Mar 2012, 10:46, archived)
# No!
Use the 'Chewbacca' defence. Never fails.
(, Fri 30 Mar 2012, 11:15, archived)
# You just reply to the extent that this is a load of old twaddle, that you did not infringe any trademark
and that the parody exists for humour only.

Tell them that, if they want, you will add a link to the real store, but that you have taken advice and do not feel that there is any case to answer here.

Then strip naked and roll on the floor.

# Alan Smeath & Co doesn't have a website.
Perhaps you could make one on their behalf....
:D

(, Fri 30 Mar 2012, 10:15, archived)
# They do own the domain though
But I'd buy AlanSmeath.org or similar and just stick a pic of a naked old man on it? Then say I'll redirect the site to my other domain?

# You create feline-themed punning websites aicmfp
(, Fri 30 Mar 2012, 10:15, archived)
# Hahaha
I hadn't seen catconverters before. Jolly nice. And as a layperson I would say only the logo is an potential infringement, as other than that it is very dissimilar.
(, Fri 30 Mar 2012, 10:17, archived)
# hmm
I do not own a cat, but wish to alter my mustache in some fashion. Has anyone happened upon tashconverters.com yet?

# SRS BSNS

# I think your reply should be...
I refer you to the reply given in the case Arkell vs Pressdram (1971).
Look it up, it's a beaut! I've used that reference on two occasions and both times the other side hasn't bothered to reply or pursue their case.

YMMV

# Surely the fact that they themselves have acknowledged that it's just a humourous jape in the first place stands in your favour?
(, Fri 30 Mar 2012, 10:56, archived)
# just change the logo, i'm sure Pimp my snack did just that and got around MTV's request about infringment.
perhaps a disclaimer on the site saying you are in no wat affiliated to cashconverters or any of their subsidary company and any likeness in the style of the website is purely coincidental.

also state that you are no way involved with the supply of catalytic converters either.

and then make a website for the solicitors as well.

# "Fair use" is a US thing
We don't have it in the UK
(, Fri 30 Mar 2012, 16:02, archived)
# Are they...
...taking the piss? No, silly me, they're lawyers... Maybe if everyone on b3ta went all guns blazing taking the piss out of Cash Converters on the twitter etc. i.e. away from b3ta, they couldn't chase everyone simultaneously, could they?
(, Fri 30 Mar 2012, 17:12, archived)
# "no pun intended"
Yeah right, that was an intended pun if ever there was one
(, Fri 30 Mar 2012, 17:54, archived)
# I feel a bit sorry for the lawyers...
...as I suspect they realise Cash Converters are being twats, but they have to do their dirty work. On the other hand, they're probably rolling in money, so fuck 'em.
