that's is just copyright infringement

tip for future refference
images with large blocks of colour are better as gifs because of their compression algorithm. jpegs are better for images with smooth colour transitions.

i've always been saving stuff as jpegs because i have photodeluxe which doesnt animate gifs...
i am so deprived...

its quite alright
it just helps you keep your image quality up and your file size down
edit: as a gif it comes to around 0.8KB instead of 20KB

With an image that simple,
the only thing that would really count against you is the fact that you yourself are asking whether or not it's plagiarism. That implies knowledge of guilt. If you removed that first line, people would just see a smiley face that could resemble any number of characters if you adjusted the proportions a tiny wee bit.
