How can a childs sole legal carer and guardian be charged with kidnap?

I am not arguining that what she did wasn't wrong, but the kidnap thing seems wrong to me. If you know what I mean....

according to wiki she was charged *only* with child neglect and perverting the course of justice, not kidnapping.
