and I can't help but feel he's gone totally the wrong way about it. He's posted tons of links to stuff they apparently hosted (which unsurprisingly have now all been removed) but that plays into funnyjunk's hands as their claim is that he defamed their website/business, effectively saying they didn't give a shit about DMCA claims... he even admits right at the top that "the energy it would['ve] take[n] to get him to take them down wasn't worth it"
I can't see how the lawyer, who apparently specialises in online media law, is going to advise his client to back down just because The Oatmeal is offering to give some money to charity.

The point is, Funnyjunk will just end up looking like such dicks that they'll have to give in, or lose visitors / advertisers. Then again they're getting loads of publicity out of it (as is The Oatmeal).

What would happen if they DO proceed with court action?
Is The Oatmeal still going to give the money to charity?
If he does then they won't look that bad after all.
If he doesn't then HE'LL look like a dick.

I reckon there's no actual legal action going on.

I expect the internet is going to get quite angry at Funnyjunk and alleged goat botherer Charles Carreon if it isn't already.

Looks like, instead of taking the opportunity to prove his claims in court, he's gone and shot his defence full of holes.

...at Funnyjunk have a track record of stealing shit without any acknowledgement.
Good on The Oatmeal for sending a picture of their mother molesting a bear to them. Oh, and raising $27,000 for charity, I guess.
