I can see why it's going under.
Massive warehouse full of beds but no customers.

I sometimes go in and wee on a mattress at random

It's an outmoded business model.
Most people download their beds illegally these days.

How they keep from going under
(, Thu 7 Mar 2013, 9:58, Reply)
It's a Pre-pack. Slightly different. It's a way of changing the company's ownership structure to reduce debt.

Way to not pay proper redundancy to 400 people or pay rent to their landlords?

Employees are protected under TUPE.

No they're not
TUPE protects an employees terms and conditions for the duration of the transfer. Once a transfer taken place they can still restructure and make you redundant or change your T+Cs
(, Thu 7 Mar 2013, 10:24, Reply)
Yes they can make redundancies, as it's the role, not the person that is made redundant. Changes to T's & C's cannot leave an employee worse off than they were before.

I have gone through this
Company A transfered to Company B on the 1st of the month. On the 2nd of the month a new director was appointed and went straight on with an obviously pre planned restructure. Holiday entitlement was no longer on top of bank holidays and three people in my department had their pay reviewed and lowered by several thousand pounds. They fought against it and all lost. There are far to many loop holes in TUPE but like they said, you can't protect someones terms and conditions forever and there is no set time period on TUPE.
